Checking DMV Records of TNC Drivers
Transportation Network Companies (TNCs) must ensure that their drivers’ Department of Motor Vehicles (DMV) records have no more than 3 points with the preceding 3 years, no “major violations” (reckless driving, hit and run, or driving with a suspended license conviction) within the preceding 3 years, and no driving under the influence conviction within the past 7 years.
The DMV’s Employer Pull Notice (EPN) program provides timely notice when any of the following are added to a driver’s record:
- Convictions
- Accidents
- Failure to appear
- Driver’s license suspension or revocation
- Any other action taken against the driving privilege
Pursuant to Public Utilities Code Section 5444, which took effect on January 1, 2016, transportation network companies are eligible and required to participate in the DMV's pull notice program for all prospective and current drivers, regardless of whether their drivers are employees or independent contractors.
TNCs must use the DMV’s Commercial Requester Account for all non-employee drivers.
If a TNC chooses to use a service provider, they may only use a DMV authorized service provider. DMV does not permit access to its records without a specific level of DMV-approved authorization.
